MADISON'S LANDSCAPES & SNOW – TERMS AND CONDITIONS
 
This estimate is for the work listed only. Any additional request for work shall be put in writing on a “Separate Approved Quote.” Please note that requested additional work is subject to additional material and labor costs and will be ADDED TO THE FINAL INVOICE.


  • All projects scheduled within 3 months of anticipated start time require a minimum of 50 percent down to schedule a tentative start date and order materials. All projects scheduled 3 months out or longer from anticipated start time require a minimum of 25 percent down to schedule a tentative start date and order materials, 25 percent prior to starting, and the remainder upon completion. Certain projects may require a customized payment schedule in which case your contractor will specify. Due to uncertainty of transportation, labor, and weather conditions, Madison's Landscapes & Snow cannot be responsible for any delay and/or effects of delay in starting and finishing a project, however work will be completed in the order in which it is scheduled.
  • Should a project come to a standstill due to a lack of supplies or poor working conditions due to weather or any other acts beyond our control, Madison's Landscapes & Snow reserves the right to “fit in” additional work while waiting for conditions to improve or waiting for supplies to arrive.
  • Customer is responsible for the health and watering of all plant material once it arrives on site.
  • Plant and landscape material will be brought based on specifications in the landscape quote. Any changes to plant material post-arrival due to size, shape, color, etc. will result in additional fees situational to trucking and material reimbursement.
  • All unforeseen conditions will be added as a change order and added to the final invoice.
  • Existing Irrigation: Madison's Landscapes & Snow is NOT responsible for any damage to irrigation due to construction. Customer is responsible for accurately marking all above ground and underground irrigation components (these include lines, wires, heads, valves, boxes, controls, etc.) prior to Madison's Landscapes & Snow commencing work. We will make every effort to care for all underground irrigation; however, since these items are not visible, we assume no responsibility for irrigation components that may incur damage during construction. Also, customers note that landscape construction could require adjustments to irrigation items following completion of work. Those adjustments are also the customer’s responsibility. Sprinkler heads may be adjusted for an additional labor charge of $100/hr. We will subcontract a service provider if needed during the project.
  • Tree & Shrub Guarantee: We pride ourselves on using only quality plant nurseries for our plant material and take great care in selecting, transporting, and installing said plant material. Where an automatic irrigation system exists, and is in proper working order, we offer a (1) year full guarantee (from the date of planting) on all trees, shrubs, perennials, groundcovers, and ornamental grasses installed by us. Should any tree or plant installed by Madison's Landscapes & Snow fail to survive in its first year, we will gladly replace, one time, that plant material. Where there is not an automatic irrigation system (or one that is not in proper working order), no guarantee is offered on plant material. This guarantee does not apply to plants that die due to chemicals, animal damage, vandalism, fire, storms, hail, drought, insects, freeze, or other uncontrollable circumstances. Transplanted plants or those not supplied by us are also excluded.
  • Downspout Drainage Systems or Drainage Systems: We provide a (3) year conditional guarantee on all downspout drain systems installed. This guarantee is void if the drain system is not properly maintained and/or altered without prior approval. Drain systems do not guarantee elimination of all basement/crawlspace flooding due to unknown subsurface conditions. They should help relieve foundation water pressure. Drainage systems are not glued to allow for expansion/contraction during freeze/thaw cycles. Property owner is responsible for keeping the system (vents, dry wells, gutters) free of debris. Drain systems do not protect against water issues due to sump pump failure or power outages.
  • General Maintenance: Unless otherwise noted, billed at $50.00 per man per hour. Includes weeding, pruning, trimming, cutting back, edging, material selection, debris removal, and other services.
  • Debris Removal: Biodegradable debris (e.g., sod, brush): $25.00 per cubic yard. Construction material (e.g., concrete, wood, pallets): $45.00 per cubic yard.
  • Seeding: Drop-seeding is NOT guaranteed. We guarantee workmanship in site prep. Heavy seeding, back raking, and E-Z Straw with Tackifier applied. Germination not guaranteed due to factors beyond our control.
  • Hardscape Installation Warranty: We warrant workmanship for (2) years from completion for paver systems, retaining/garden walls, landings, steps, patios, and driveways. Exclusions: damage from tree roots, machinery, or excessive weight; changes or repairs made by others; efflorescence, stains, pitting, weed growth; improper cleaning (e.g., power washing without approval); excavation within 4 feet of install or within 4 years by other entities. Repairs due to covered warranty issues will be performed by Madison's Landscapes & Snow or an approved subcontractor. Material color will be matched as close as possible but may vary. Warranty void if alterations are made by others, if final payment is late, if improper use or maintenance occurs, or due to acts of God. Shifted or sunken pavers due to improper use such as vehicles, lawn mowers, tractors, or heavy equipment driving on or off the edges are not covered under the warranty.
  • Late Payment: Final payment is due upon job completion. Late payment voids warranty. If a warranty claim is made, it must be within the 5-year window and be completed by us or approved subcontractor. Any deviation from the agreed scope requiring additional cost will require written approval and payment before proceeding.
  • Drainage Under Hardscape: If drainage is installed beneath hardscape, that portion follows the same warranty terms as the drainage system outlined above.

Snow & Ice Management Terms and Conditions
Madison’s Landscapes & Snow provides snow and ice management services in accordance with the terms outlined in the client’s service agreement or approved estimate. Services include snow plowing, salting, shoveling, and de-icing based on the scope of work selected.


  • Service Triggers: Snow removal is typically performed when snowfall meets or exceeds the trigger depth stated in the agreement (e.g., 1", 2", or per-event). Services will be dispatched within a reasonable time after accumulation ends or as agreed upon in advance.
  • Timing: While every effort is made to service properties promptly, exact timing cannot be guaranteed due to route volume, weather severity, and other operational limitations. Priority is given to commercial clients with critical access needs.
  • Obstructions & Access: Client must ensure that driveways, walkways, and service areas are free from obstructions such as vehicles, trash bins, or other objects that may impede snow removal. Madison’s Landscapes & Snow is not responsible for incomplete service due to blocked areas.
  • Surface Damage Waiver: While care is taken during service, Madison’s Landscapes & Snow is not liable for damage to driveways, curbs, grass adjacent to plow areas, landscaping, or hidden items (e.g., irrigation heads, cables) that are not clearly visible or marked. Snow equipment may scratch or scuff surfaces over time due to repeated clearing.
  • De-Icing Products: Standard de-icing materials (e.g., treated salt, calcium chloride) will be used unless otherwise specified. Madison’s Landscapes & Snow is not responsible for staining, surface etching, or long-term wear caused by salt or ice melt.
  • Weather Conditions: Due to the unpredictable nature of snow events, Madison’s Landscapes & Snow does not guarantee zero accumulation at all times. Services aim to reduce hazards and maintain accessibility but cannot eliminate all snow or ice hazards entirely.
  • Communication & Changes: All service changes or special requests must be submitted in writing. Last-minute service cancellations made after dispatch are subject to a service fee.
  • Seasonal Contracts: Unless otherwise noted, seasonal pricing covers snow events between November 1 and March 31. Excessive snowfall (e.g., over 70” in a season) or blizzard conditions may require additional billing if agreed upon in the original contract terms.
  • Per-Push/Per-Event Work: Per-push clients will be invoiced following each event. Rates are based on accumulation depth, ice conditions, and services rendered.
  • Liability: Madison’s Landscapes & Snow holds active insurance coverage but is not liable for slip and fall incidents once service has been rendered. Property owners should monitor conditions and communicate any concerns promptly.
